OVERDRAGELSE AF RETTIGHEDER #YESOBH

LÆS VENLIGST GRUNDIGT Ved at svare på vores kommentar med hashtagget #YESOBH ("Samtykkehashtagget") accepterer du eller den organisation eller person, du repræsenterer, at være bundet af vilkårene i denne aftale og blive part i denne aftale ("Aftalen"), ud over OBH Nordicas Privatlivspolitik og Brugsbetingelserne, der er tilgængelige på https://www.obhnordica.dk/ sammen med OBH Nordica, dets medarbejdere, tilknyttede selskaber, datterselskaber, licenshavere, overdragere, juridiske repræsentanter og arvinger (samlet kaldet "Brandet").

Du giver også OBH Nordica ret til at bruge et fotografi eller en video taget af dig og lagt ud på sociale netværk og andre identificerende oplysninger, der er knyttet til dit indlæg, såsom dit brugernavn, billede, lighed, billedtekst og hashtags (og navnet og billedet på enhver anden person, der er inkluderet i dit indlæg) og yderligere indhold, som du måtte vælge at give, såsom dit navn og din e-mail-adresse (samlet "Brugerindhold").

Hvis du ikke accepterer alle vilkårene i denne aftale, må du ikke poste samtykke-hashtagget.

Hvis du indgår denne aftale på vegne af en organisation eller person, erklærer du, at du har bemyndigelse til at gøre det.

LICENS Du giver hermed OBH Nordica en ikke-eksklusiv, evigvarende, royaltyfri, uigenkaldelig, verdensomspændende ret og licens (herunder retten til at underlicensere til tredjeparter) til at bruge, udnytte, formidle, reproducere, redigere, vise, tilpasse, distribuere, overføre og på anden måde bruge brugerindholdet i forbindelse med markedsføring og promovering af brandet på enhver måde og i ethvert medie, der nu er kendt eller senere opfundet, herunder uden begrænsning på brandets websteder, for eksempel i brandoprettede historier, forhandlerwebsteder, markedsførings-e-mails og sociale medier, herunder i betalte reklamer på sociale netværk, som du ikke vil blive betalt for.

Denne overførsel er gratis.

ERKLÆRINGER OG GARANTIER Du beholder alle rettigheder, ejendomsret og interesser i og til brugerindholdet og erklærer og garanterer, at (i) du ejer alle rettigheder til dit brugerindhold, eller, hvis brugerindholdet er underlagt tredjeparts ejendomsrettigheder, at du har alle nødvendige licenser, rettigheder, samtykker og tilladelser til at sende det brugerindhold, du indsender, og til at give de rettigheder, der er tildelt i henhold til denne aftale, herunder tilladelse til at bruge rettighederne for enhver person, der optræder i brugerindholdet, (i) du ejer alle rettighederne til dit brugerindhold, eller, hvis brugerindholdet er underlagt tredjeparts ejendomsrettigheder, du har alle nødvendige licenser, rettigheder, samtykker og tilladelser til at offentliggøre det brugerindhold, du indsender, og til at give de rettigheder, der er givet i denne aftale, herunder tilladelse til at bruge rettighederne for enhver person, der optræder i dit brugerindhold, i forbindelse med dette program og uden økonomisk modydelse (ii) du er 18 år eller ældre, (iii) du er juridisk berettiget til at sende brugerindholdet, og brug af tredjeparters ejendomsrettigheder indeholdt i dit brugerindhold, som beskrevet i denne aftale, vil ikke krænke tredjeparters rettigheder, herunder, men ikke begrænset til, varemærkerettigheder, privatlivets fred, offentlighedsrettigheder eller andre ejendomsrettigheder eller nogen lov, og (iv) brugerindholdet er ikke injurierende, ærekrænkende, uanstændigt, pornografisk, voldeligt, uanstændigt, truende, chikanerende, hadefuldt eller stødende.

FRITAGELSE :Du fritager hermed OBH Nordica, dets underleverandører og hver af OBH Nordicas og sådanne underleverandørers respektive medarbejdere, underleverandører, direktører, leverandører, repræsentanter, kunder og licenstagere fra ethvert ansvar, krav og udgifter, herunder rimelige advokatsalærer, der vedrører ethvert brud eller påstået brud fra din side på ethvert vilkår i denne aftale.

DIVERSE Denne aftale er udelukkende underlagt dansk lov.

Parterne skal bestræbe sig på i mindelighed at løse eventuelle vanskeligheder i forbindelse med gyldigheden, udførelsen og/eller fortolkningen af Aftalen og dens konsekvenser. Hvis de ikke gør det inden for femten (15) dage, skal enhver tvist indbringes for de kompetente domstole i Danmark.

TRANSFER OF RIGHTS #YESOBH

PLEASE READ CAREFULLY By replying to our comment with the hashtag, #YESOBH (the "Consent Hashtag"), you or the organization or individual you represent agree to be bound by the terms of this agreement and become a party to this agreement ("Agreement"), in addition to OBH Nordica’s Privacy Policy and the Terms of Use available at https://www.obhnordica.dk/ together with OBH Nordica, its employees, affiliates, subsidiaries, licensees, assigns, legal representatives and heirs (collectively, the "Brand").

You also grant OBH Nordica  the right to use a photograph or video taken by you and posted on social networks and other identifying information associated with your post, such as your username, image, likeness, caption and hashtags (and the name and image of any other person included in your post) and additional content that you may choose to provide, such as your name and email address (together, the "User Content")

If you do not agree to all the terms of this agreement, do not post the consent hashtag.

If you are entering into this agreement on behalf of an organization or individual, you represent that you have the authority to do so.

LICENSE You hereby grant OBH Nordica a non-exclusive, perpetual, royalty-free, irrevocable, worldwide right and license (including the right to sublicense to third parties) to use, exploit, disseminate, reproduce, edit, display, adapt, distribute, transmit and otherwise use the User Content in connection with the marketing and promotion of the Brand in any manner whatsoever and in any media now known or later invented, including, without limitation, on the Brand's websites, for example, in Brand-created stories, retailer websites, marketing emails and social media, including in paid advertisements on social networks for which you will not be paid.

This transfer is made free of charge.

REPRESENTATIONS AND WARRANTIES You retain all right, title and interest in and to the User Content and represent and warrant that (i) you own all rights in your User Content, or, if the User Content is subject to third party proprietary rights, you have all necessary licenses, rights, consents and permissions to post the User Content you submit and to grant the rights granted by this Agreement, including permission to use the rights of any person(s) appearing in the User Content, (i) you own all of the rights to your User Content, or, if the User Content is subject to third party proprietary rights, you have all necessary licenses, rights, consents and permissions to publish the User Content you submit and to grant the rights granted by this Agreement, including permission to use the rights of any person(s) appearing in your User Content, in connection with this program and without financial consideration (ii) you are 18 years of age or older, (iii) you are legally entitled to post the User Content, and use of the proprietary rights of third parties contained in your User Content, as described in this Agreement, will not violate the rights, including but not limited to trademark, privacy, publicity or other proprietary rights, of any third party or any law, and (iv) the User Content is not libelous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful or offensive.

RELEASE You hereby release, discharge and agree to defend, indemnify and hold harmless OBH Nordica, its subcontractors and each of OBH Nordica's and such subcontractor's respective employees, subcontractors, directors, suppliers, representatives, customers and licensees from any and all liabilities, claims and expenses, including reasonable attorneys' fees, that relate to any breach or alleged breach by You of any term of this Agreement.

WITHDRAW CONSENT If you want to withdraw consent to share your content with OBH Nordica you have to contact us by email at digitalse@tefal.com, or our Partner Cevoid at info@cevoid.com, or visit https://upload.cevoid.com/data/remove.

MISCELLANEOUS This Agreement is governed exclusively by Danish law.

The Parties shall endeavor to settle amicably any difficulties relating to the validity, performance and/or interpretation of the Agreement and its consequences. If they fail to do so within fifteen (15) days, any dispute shall be submitted to the competent courts of Denmark.
